DECISION OF THE COURT
The Court having heard the arguments of counsel in open court, having reviewed the files and records herein and being otherwise fully advised, Now Therefore;
The Court fmds that the Defendants' alleged criminal activity herein is separate and distinct from the fishing activity which occurred prior thereto by the Schwartzes which fell under the exclusive jurisdiction of the Sault Ste Marie Tribal Court. The fact that the fish involved in the illegal sale by the Jensens' may have been caught illegally, is collateral at best in the wrongful activity they are charged with being engaged in, in the Complaint.
The Court therefore denies Defendants' Motion to Dismiss and further declines to suspend the prosecution or delay the trial herein pending a decision in Federal Court.

The lawyers for the Bay de Noc Great Lakes Sport Fishing club have asked us to let interested anglers who have been affected and damaged by the illegal fishing know that well behaved public attendance at the trial is within your rights.  An orderly showing of public support by interested spectators could be helpful.
The Daily Press article said "Today's proceedings will take place in the probate court courtroom, which is larger than the district courtroom." I would assume the rest of the trial will take place there, as well. If you have a chance, take a little free time to observe the proceedings, and show you're support for the fishery.

hopefully everyone talking on this site has never kept a 14 1/2 in eye or maybe #6 in the bucket?  otherwise we'd all be hipocrits!  good luck on the opener this weekend,  there's lots of em out there!
